Terms of Use

These Terms govern access to and use of the BuildQuant website and BuildQuant Atlas platform, including free trials, subscriptions, reports, data and development intelligence.

By creating an account, starting a trial, purchasing a subscription or otherwise using BuildQuant Atlas, you agree to these Terms. If you do not agree, you should not use the platform.

1. About BuildQuant Atlas

BuildQuant AI Pty Ltd provides BuildQuant Atlas, a development intelligence and decision-support platform designed to help users identify and assess potential property development opportunities.

Atlas combines property, planning, site, market, construction and commercial indicators into structured outputs intended to support early-stage development screening.

2. Decision-support only

Atlas is a decision-support tool. It is not a planning authority, certifier, architect, engineer, surveyor, valuer, quantity surveyor, financial adviser, legal adviser or other professional consultant.

Atlas outputs are indicative only and should not be relied on as confirmation of planning approval, development approval, buildability, subdivision potential, construction cost, market value, project feasibility, profitability or investment outcome.

Independent verification is required.

Before making an acquisition, development, design, finance or investment decision, users should obtain appropriate independent professional advice and confirm relevant information with the applicable authorities and service providers.

3. Data and information sources

Atlas may use information obtained from third-party data sources, public records, property listings, planning information, market information and other external services.

We take reasonable steps to provide useful and current information, but third-party information may be incomplete, delayed, inaccurate, unavailable or subject to change without notice.

BuildQuant does not control all external data sources and cannot guarantee that third-party information is complete, accurate or current at all times.

4. Planning information

Planning information shown in Atlas may include zoning, floor space ratio, building height, lot dimensions, development pathways, hazards and other indicators relevant to development potential.

Planning controls can vary by property, council area, planning instrument, date and development pathway. Additional controls, exclusions, overlays, site constraints or local requirements may apply.

Users must independently confirm planning requirements applicable to the specific property before relying on them for development decisions.

5. Construction cost information

Construction costs shown in Atlas are indicative estimates based on assumptions, rates, allowances and available site information.

Actual construction costs can vary materially due to design, specification, site conditions, market conditions, labour, materials, procurement, authority requirements, contractor pricing and other factors.

Atlas construction cost information does not replace a detailed estimate, trade quotation, quantity surveyor cost plan, tender or contractual construction price.

6. Market and revenue information

Market values, comparable evidence, potential sale values and revenue outputs are indicative only.

Property values may change and are influenced by factors including location, property condition, design, specification, market demand, comparable transactions, interest rates and broader market conditions.

Atlas does not provide a formal property valuation.

7. Feasibility and commercial outputs

Feasibility, profit, margin, acquisition thresholds and other commercial outputs are calculated using assumptions and available data.

These outputs are intended for preliminary screening and should not be treated as a guarantee of actual development profit or project performance.

Users are responsible for reviewing the assumptions and obtaining professional feasibility, finance, taxation, valuation and legal advice where appropriate.

8. Accounts and access

Users must provide accurate account information and keep login credentials secure.

You are responsible for activity occurring through your account unless the activity results from a security failure for which BuildQuant is legally responsible.

You should notify us promptly if you believe your account has been compromised.

9. Free trial

Eligible users may receive a BuildQuant Atlas free trial.

Unless otherwise stated at signup, the trial ends after:

  • • 7 days; or
  • • 10 Atlas searches,

whichever occurs first.

Trial eligibility may be limited to prevent repeated or abusive trial use.

10. Subscription plans

Atlas subscription plans, pricing, included searches and features are shown on the Pricing page and during checkout.

Current plans include Atlas Pro and Atlas Premium, with month-to-month and 12-month commitment billing options.

The applicable price, billing frequency, included search allowance and commitment period will be displayed before purchase.

11. Monthly usage allowances

Subscription plans may include a defined number of Atlas searches within each billing period.

Unused monthly search allowances do not carry forward unless BuildQuant expressly states otherwise.

Search allowances are associated with the subscribed account and may not be resold, transferred or pooled across unrelated accounts without written approval.

12. Month-to-month subscriptions

Month-to-month subscriptions renew monthly unless cancelled in accordance with the subscription controls available through the platform or applicable billing process.

Cancellation generally takes effect at the end of the current paid billing period unless otherwise stated.

13. Twelve-month commitment plans

A 12-month commitment plan provides a reduced monthly price in exchange for a minimum 12-month subscription commitment.

Fees are billed monthly during the commitment period unless otherwise stated at checkout.

During an active commitment:

  • • upgrades to a higher committed plan may take effect immediately;
  • • downgrades may take effect from the next billing period and may begin a new commitment period;
  • • switching to a cancel-anytime plan may be restricted until the current commitment expires.

Specific subscription changes are subject to the options shown in the platform and applicable consumer or small-business rights.

14. Payments

Subscription payments are processed through third-party payment providers.

You authorise the applicable payment provider to charge the payment method selected during checkout for fees due under your subscription.

If a payment fails, access may be restricted or suspended while the billing issue remains unresolved.

15. Refunds

Refunds are handled in accordance with applicable law and the circumstances of the transaction.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

16. Acceptable use

You must not use BuildQuant Atlas to:

  • • engage in unlawful activity;
  • • attempt to gain unauthorised access to systems or accounts;
  • • interfere with the operation or security of the platform;
  • • scrape, copy, systematically extract or reproduce Atlas data outside normal permitted use;
  • • reverse engineer, decompile or attempt to discover proprietary platform logic except where such restriction is prohibited by law;
  • • resell or commercially redistribute Atlas access, outputs or data without written permission;
  • • use automated systems in a manner that places unreasonable load on the service.

17. Intellectual property

BuildQuant retains ownership of the BuildQuant name, BuildQuant Atlas platform, software, interfaces, proprietary methodologies, reports, templates, branding and other intellectual property, subject to third-party rights.

Your subscription provides a limited right to use Atlas for your own authorised business purposes during the subscription period.

18. Reports and exports

Reports and exports generated through Atlas may be used internally for legitimate development assessment and business purposes.

Atlas reports should retain any disclaimers, source notes or qualification statements included in the report.

Users must not present Atlas outputs as guaranteed planning, valuation, engineering, construction or investment advice.

19. Availability and changes to the service

We aim to provide reliable access to Atlas but do not guarantee uninterrupted or error-free operation.

Maintenance, upgrades, third-party outages, internet failures or events outside our reasonable control may affect availability.

We may update, improve or change features from time to time. Where a change materially affects an active paid subscription, we will take reasonable steps to communicate the change where appropriate.

20. Suspension or termination

We may suspend or restrict access where reasonably necessary to protect platform security, address non-payment, investigate misuse or respond to a material breach of these Terms.

Where reasonably practicable, we will provide notice and an opportunity to remedy the issue before permanent termination, unless immediate action is reasonably required for security, legal or serious misuse reasons.

21. Liability

To the extent permitted by law, BuildQuant is not responsible for losses arising solely from a user relying on indicative Atlas outputs without undertaking appropriate independent verification and professional due diligence.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including rights and remedies that cannot be excluded under the Australian Consumer Law.

Users remain responsible for their own acquisition, planning, design, development, construction, finance and investment decisions.

22. Third-party services and links

Atlas and the BuildQuant website may interact with or link to third-party websites, platforms, property listings, payment services and other external services.

Third-party services operate under their own terms, privacy policies and availability arrangements.

23. Privacy

Personal information is handled in accordance with our Privacy Policy.

You can review the Privacy Policy on the BuildQuant website.

24. Changes to these Terms

We may update these Terms from time to time to reflect changes to the service, subscriptions, technology or legal requirements.

Material changes affecting an existing paid subscription will be handled consistently with applicable law and any contractual commitments already in effect.

25. Governing law

These Terms are governed by the laws of New South Wales, Australia, subject to any mandatory rights or jurisdictional requirements that apply.
